Conservative law professor unloads on White House counsel Don McGahn for drafting Trump's NDAs

Adam White, a conservative professor at George Mason University's Antonin Scalia Law School and a research fellow at the right-wing Hoover Institute, found himself utterly appalled by new revelations that President Donald Trump has been trying to use nondisclosure agreements to silence former staffers who have since left his administration.

Trump on Monday tweeted out that estranged former ally Omarosa Manigault-Newman had already signed an NDA that he claimed should have guaranteed her silence after being fired from the White House last year.

In response to this, New York Times reporter Julie Davis noted on Twitter that she had reported earlier this year that White House counsel Don McGahn had written up the NDAs under pressure from Trump -- despite the fact that he knew that they would not be enforceable in a court of law.

Responding to Davis' tweet, White said he was in shock that McGahn would stoop to writing up agreements aimed at intimidating and silencing government employees from speaking publicly.

"That's astonishing," White wrote. "It's no answer to say, 'he knew they were unenforceable.' The White House Counsel shouldn't in the business of writing unenforceable contracts for political reasons. Tell your client 'no.'"
