Former Maricopa County Attorney calls for criminal investigation into Cyber Ninjas CEO

Reacting to a report that Cyber Ninjas CEO Doug Logan has refused for more than a year and a half to turn over communications about his company's "audit" of the 2020 presidential election results despite a court order, former Maricopa County Attorney Rick Romley, a Republican, is calling for a criminal investigation alleging a possible felony violation.

According to a report from AZCentral, Romley is asking both county and state prosecutors to investigate Logan, saying he is violating a state law that holds that withholding public records can be charged as a Class 6 felony.

In a statement, Romley asserted, "Clearly, it warrants a criminal investigation for potential tampering of public records. This could even move into fraudulent schemes."

Elaborating on his comments he added that refusing to comply becomes a crime when someone "conceals, removes or otherwise impairs the availability of any public record" with the intent to "defraud or deceive."

The report states, "Romley said thousands of messages Logan has released in response to a public records lawsuit filed by The Arizona Republic suggest Cyber Ninjas might have perpetrated fraud by taking millions for an election review that appeared to have a predetermined outcome and could not be completed."

As he explained, "The most obvious case is the failure to obey court orders. But the text messages themselves raise the specter that there could be corruption here."

In a statement from the Maricopa County Attorney's Office, Deputy Chief of Staff Jeanine L'Ecuyer begged off, for the moment, stating, "We decline to comment because there is no case before this office."
