The prosecutor in Kyle Rittenhouse's trial in Kenosha could have caused a mistrial on Wednesday, MSNBC legal analyst Danny Cevallos explained.
Judge Bruce Schroeder chastised Assistant District Attorney Thomas Binger during a break in the jury trial.
MSNBC's Chuck Todd asked Cevallos about the reprimand.
"It was well deserved," Cevallos said.
"You saw the reasons — and they are kind of arcane legal concepts if you're not someone who watches a lot of court TV or court events — but I mean we're talking about bedrock rules. The judge is right," he explained. "Propensity evidence, character evidence as we call it, you can't introduce bad things that a defendant did in the past and say, 'Oh, he did bad things before, he's doing bad things this time.' And the other things and other bedrock principle, you can't comment on post-arrest silence."
