Jack Smith to Judge Aileen Cannon: Trump defendants 'have yet to produce any discovery'

Special counsel Jack Smith notified U.S. District Court Judge Aileen Cannon that former President Donald Trump and his co-defendants, Walt Nauta and Carlos De Oliveira, "have yet" to produce any discovery materials.

In a three-page filing on Tuesday, Smith noted that the special counsel's office had fulfilled its obligations to turn over information about the classified documents case against Trump.

"In accordance with the Court's Order of November 10, 2023 (ECF No. 215), the United States of America files this discovery report," Smith wrote. "That Order contemplates a Joint Discovery Report being filed, but as the Defendants have yet to produce any discovery, the Government has prepared this Report."

Smith said the prosecution made "eight productions of unclassified discovery," while Trump made none.

Counsel for Trump and his co-defendants did not dispute the claim.

The former president was indicted last year on 37 counts of mishandling classified documents.
