Former Justice Department official John Yoo believes Donald Trump will likely lose his immunity case before the Supreme Court of the United States.
Yoo, known as a "torture lawyer" for his role in authorizing enhanced interrogations, happened to be interviewing on Fox News when they first reported that Trump was petitioning the high court for a stay in the case where an appeals court shot down the idea of absolute immunity from prosecution.
Yoo accused the court system of being "very unfair" to Trump, but predicted that the former president would lose his immunity bid. Trump has used presidential immunity as a defense in a federal election subversion case. It was struck down by the Washington, D.C. Circuit Court of Appeals

"This is not unexpected," Yoo told Fox News anchor Sandra Smith. "He needs to have the opportunity to take this argument all the way to the Supreme Court."
"Now, I don't think his chances are all that great at the Supreme Court," he added. "I think he's probably likely to lose."
Yoo concluded by noting that Trump's legal strategy was to delay the trial — even if it meant losing on appeal.
