Judge Cannon just showed her 'inexperience' or 'bias' in latest Trump hearing: expert

Judge Aileen Cannon, the jurist overseeing Donald Trump's criminal case over allegedly stashed confidential documents, showed that she's either in the bag for the former president or that she's too much of a novice on the bench to handle the momentous case, a former prosecutor said on Friday.

Andrew Weissmann, the former top prosecutor on former special counsel Robert Mueller's team, gave his thoughts on Cannon's hearing from earlier Friday, where she fielded recommendations from both sides on potential trial dates in 2024.

She didn't settle on a date, but she did bring up a DOJ rule that she appeared to misinterpret, according to Weissmann's comments.

"Why was Judge Cannon today asking Jack Smith’s team about a DOJ 60-day policy given that it provides a defendant NO enforceable rights and is also plainly inapplicable," he said on Friday. "It shows her inexperience, or her bias, or both. IMHO."

Weissmann was referring to Department of Justice guidance on conducting prosecutions of politicians near elections.

He continued:

"The 60-day rule is both not a law (just internal DOJ Guidance) and inapplicable. It’s meant to not make new allegations shortly before an election when a person can’t have a trial to confront them."

Finally, Weissmann concluded by demonstrating how this case is in opposition to those in which the rule would be applicable.

"This is the opposite: already public charges the US seeks to prove at a trial!" the ex-prosecutor wrote.
