Judge dismisses former Fox News personality Andrea Tantaros’ sexual harassment lawsuit against network

A federal judge rejected Andrea Tantaros’ claims against Fox News on Friday.

Tantaros a former co-host of The Five, filed a lawsuit against Fox News in April 2017. She claimed that her computer was wiretapped and that female workers were secretly recorded getting undressed in the wardrobe department.

U.S. District Court Judge George Daniels rejected the claims because it was based on "speculation" and "conjecture."

"Even if Fox News or another Defendant was responsible for installing malware on Plaintiff's personal computer — a conclusion for which there is scant factual support — Plaintiff's allegations at most support an inference that Defendants had the capability to intercept her communications," Daniels wrote in the disclosure. "Such allegations, however, are insufficient to survive a motion to dismiss."

Tantaros' case wasn't strong enough because she did not have strong technical evidence to support her claims.

Daniels wrote that Tantaros: "pleads no facts to support this belief, much less ones to make her unsubstantiated allegations rise above the speculative level... Moreover, even assuming that recording equipment was installed in Plaintiff's office and in the locations where the bi-annual trunk show were held, Plaintiff does not allege that any of her communications were actually intercepted, as required by the statute."

The Hollywood Reporter, said that Tantaros’  also lost a claim alleging to emotional distress.
