'Judges weren't having that': Expert describes how Trump's gag order argument fell apart
Former President Donald Trump's attorney John Sauer did not fare well at Monday's appeal court hearing on the gag order imposed in the 2020 election interference case — and on MSNBC's "Katy Tur Reports," legal analyst Lisa Rubin broke down how it went so wrong for his arguments.
"The idea of violence — the Trump team argued that you can't just say that there's going to be violence without there actually being violence," said Tur. "What Donald Trump has said regarding this case hasn't resulted in anything concrete, and this is what they're arguing."
"And it's basically Minority Report — you can't go out there and judge somebody for something that hasn't happened. The judges didn't buy that. Why?"
"They didn't buy that on two fronts," said Rubin. "One, they said we shouldn't have to wait for someone to get hurt to take prophylactic steps to protect the integrity of the administration of justice and to ensure the safety of witnesses and other participants."

"The other thing they didn't buy was John Sauer's insistence that anything Donald Trump has said had concrete impact," Rubin continued. "They said, wait a second, shortly after the indictment, he said, 'If you're coming after me, I'm coming after you,' and shortly thereafter Judge [Tanya] Chutkan was threatened by a woman in Texas who is now in federal detention.
"And John Sauer tried to diminish that case, and basically say, well that's a woman who's a crazy alcoholic, if you look at her detention order, there are a number of factors in her case, a long history of substance abuse."
The judges, Rubin continued, "Weren't having that either."
"If you are going to go on social media in this era, how do you know that Mrs. [Abigail] Shry, who is the defendant in that case, is the only one willing to follow what Donald Trump said to its logical conclusion?" said Rubin. "The answer is we don't. We don't know how many possible lone wolves are out there hanging on his every word."
