Republicans plot revenge for Steve Bannon indictment — but forget the legal requirements

Steve Bannon was indicted by a grand jury on Friday after being referred for criminal contempt by the House Select Committee investigating the attack on the U.S. Capitol Jan. 6. Now, Republicans are threatening "payback."

The Washington Post revealed Sunday that the GOP thinks Democrats are "weaponizing" the Justice Department, saying that they will go after President Joe Biden and his aides, though they didn't specify why.

For Republicans to do what Democrats did to Bannon, they would have to take back Congress, start their own House committee to investigate Biden, call the witnesses and then assume that the witnesses wouldn't appear. Then, if they don't, the Republicans would have to convince the Justice Department to impanel a grand jury and the grand jury would then have to indict the Biden aides.

"For years, Democrats baselessly accused President Trump of 'weaponizing' the DOJ. In reality, it is the Left that has been weaponizing the DOJ the ENTIRE TIME — from the false Russia Hoax to the Soviet-style prosecution of political opponents," tweeted Rep. Elise Stefanik (R-NY), the third-ranking House Republican who took over Rep. Liz Cheney's (R-WY) position.

The Russia investigation happened under former President Donald Trump and his Justice Department and during a Republican Congress and Senate. Special Counsel Robert Mueller is a registered Republican.

"Joe Biden has evicerated (sic) Executive Privilege," Jordan tweeted, misspelling eviscerated. "There are a lot of Republicans eager to hear testimony from Ron Klain and Jake Sullivan when we take back the House."

Executive privilege is only valid for the existing administration or if the existing administration agrees to the declaration of privilege. Jordan wouldn't be able to get Biden staff to go outside of that privilege until after Biden is out of office and only if the existing president says that Biden's staff must comply.

Biden and Attorney General Merrick Garland have been cautious and indicated that they would prefer to avoid investigations into the Trump White House. Biden told voters he wanted to look forward. It has been a massive conflict between the Biden administration and Democratic voters, who had accountability on their minds when voting in 2020.

If Republicans are already claiming that Democrats are weaponizing the Justice Department, it could open the door for Democrats to do exactly that.
