The infamous recording of Donald Trump boasting in 2005 that he can grab women sexually can be presented as evidence in E. Jean Carroll’s civil trial against him, a judge ruled Tuesday.
U.S. District Court Judge Lewis Kaplan also banned Trump’s lawyers from suggesting in court that he didn’t sexually abuse the former journalist, questioning her mental health or discussing her sex life, court records show.
"It could be found to be a unique window into Mr. Trump’s mind provided in his own words and his own voice," Kaplan writes of the tape. "While a jury might find Mr, Trump’s statements on the video quite offensive, rather than being simply untruthful 'locker room talk,' that risk does not outweigh their probative value."
Kaplan’s ruling comes days after Trump posted 31 “bizarre and psychopathic” Truth Social posts about Carroll in under 30 minutes.
Carroll is suing Trump for defamation after he was found liable for attacking her in a luxury Manhattan department store in the early 1990s, yet continued to deny her claims. Trump was ordered to pay $5 million in damages.

The trial, largely to decide on another slate of damages, is set to start on Jan. 15.
Kaplan’s ruling means Carroll’s attorneys can play the Access Hollywood tape that almost threatened his presidential campaign when it surfaced just before the election in 2016. A hot mic on the “Days of Our Lives” set in 2015 recorded Trump boasting to Billy Bush about the perks of power when it comes to women.
“I just start kissing them,” Trumps says. “When you’re a star, they let you do it. You can do anything. Grab ’em by the p----. You can do anything.”
