Trump asks Judge Aileen Cannon to reschedule hearing so he can attend N.Y. court

Former President Donald Trump has asked U.S. District Court Judge Aileen Cannon to reschedule a hearing so he can attend court in New York, where he has been accused of 34 counts of falsifying business records.

In a motion filed on Monday, attorneys for Trump told Cannon that he had a conflict for a scheduled Classified Information Procedures Act (CIPA) hearing on Feb. 15 and 16.

"As Your Honor is aware, on April 4, 2023, President Trump was indicted and arraigned in New York County on a 34-count indictment charging him with Falsifying Business Records in the First Degree, in violation of New York Penal Law," the filing said.

"Although President Trump’s schedule could change, we anticipate that President Trump will be present in person for the February 15, 2024 hearing in New York."

Trump's motion suggested a date of Feb. 12 or earlier for the CIPA hearing. The document also said special counsel Jack Smith did not oppose moving up the date.
