Trump lawyers' defense will flop in court and lead to a 'short jury deliberation': CNN legal analyst
CNN legal analyst Jennifer Rodgers on Thursday mowed down a new defense of former President Donald Trump that was floated by former Trump attorney Tim Parlatore earlier this week.
In particular, Parlatore argued that Trump couldn't have broken the law against retaining top-secret government documents because the documents in his possession were photocopies rather than originals.
Rodgers said that she thought so little of this defense that she doubted Trump's legal team would even bother trying it out in court.
"If that's going to be their legal defense in court, then it's going to be a short jury deliberation," she predicted. "It's helpful to think of it in buckets: There are statutes that prohibit having and disseminating national defense information. That doesn't have to be in a document, that is just information... Classified information is classified. Even if there are ten document that are all the same, that all say classified, they're all classified. You can't have any of them."
She then argued that she couldn't see a plausible way to defend Trump legally using any of the arguments that his lawyers have floated so far.
"There is no defense here to anything that the special counsel is considering charging," she said. "So, I think that which they finally do get into the courtroom, that is not what we're going to hear from them."
