Legal expert reveals why Trump’s lawyers are fighting to keep certain tweets out of court

MSNBC legal analyst Lisa Rubin revealed Monday one major reason Donald Trump's lawyers are fighting so hard to keep certain tweets he sent as president out of his criminal hush money trial.

Rubin stood outside the Manhattan court where Trump stands accused of covering up money paid to adult film star Stormy Daniels through his then-attorney, Michael Cohen. She discussed one of many legal battles the former president will face in the weeks ahead.

"Trump himself has tweeted that he repaid Michael Cohen," Rubin explained with a laugh. "That's why his lawyers are fighting so hard to keep that out on grounds of presidential immunity."

Trump's lawyers tried to argue that Trump's tweets were official acts because they were written by a standing U.S. president, Rubin explained.

Rubin argued there existed an underlying reason why Trump's legal team wanted to keep his social media messaging away from the jury.

"But really, the reason they're fighting so hard about those is the facts in fact aren't contested at all," Rubin said. "They're just hoping there is one or more people that on this perspective jury that, even if they don't fit the mold of what a Trump juror should look like, is going to side with them in the end."

This is not the first time Trump's lawyers have cried presidential immunity.

Trump's legal team is slated to make an argument in front of the Supreme Court next week. They're tasked with deciding whether Trump can be prosecuted in special counsel Jack Smith's federal election interference case.

Rubin referenced a series of tweets Trump posted on May 3, 2018, where he admitted making payments to Cohen and a non-disclosure agreement, or NDA.

"Mr. Cohen, an attorney, received a monthly retainer, not from the campaign and having nothing to do with the campaign, from which he entered into, through reimbursement, a private contract between two parties, known as a non-disclosure agreement, or NDA. These agreements are very common among celebrities and people of wealth,," Trump wrote.

"In this case," he continued in the second tweet, "it is in full force and effect and will be used in Arbitration for damages against Ms. Clifford (Daniels). The agreement was used to stop the false and extortionist accusations made by her about an affair, despite already having signed a detailed letter admitting that there was no affair. Prior to its violation by Ms. Clifford and her attorney, this was a private agreement."

"Money from the campaign, or campaign contributions, played no roll [sic] in this transaction," he closed.
