Donald Trump recently claimed immunity from prosecution in his federal election subversion case, but that argument is going nowhere, according to a former Watergate prosecutor on Thursday.
Assistant Watergate prosecutor Jill Wine-Banks during an appearance on MSNBC's The Beat With Ari Melber was asked about Trump's claim of presidential immunity, and whether it's valid.
Wine-Banks answered that he would have to be doing something "presidential, something within his job description."
POLL: Should Trump be allowed to run for office?
"We've already seen a court saying 'it's not with in your job description to defame E. Jean Carroll, it just isn't.' And I think they would say the conduct alleged in this particular indictment goes well beyond anything that is part of his job as president," Wine-Banks said.
She added that it was his job as a "candidate," and a "candidate is a different thing."
"He cannot claim he was acting as president when he was trying to take down the election. That is a question of fact that will have to be determined. The jury will say yes, he was trying to take it down. He will say no I wasn't, I was trying to protect election integrity. There is no evidence that supports that and if he testifies that, he will be destroyed on cross-examination."
