Trump was given an 'opportunity for mischief' in Supreme Court immunity case: analyst

The Supreme Court is now weighing whether they will take up a review of the D.C. Circuit Court's ruling that former President Donald Trump does not have presidential immunity in the federal election conspiracy case brought by special counsel Jack Smith — and the former president is desperate to delay and drag out the process at all costs so the trial can't happen during the election.

To that end, Slate legal analyst Mark Joseph Stern told MSNBC's Alex Wagner on Wednesday evening, there is one devious trick Trump could pull to try to force the justices to wait as long as possible.

Jack Smith just turned Trump's arguments 'on their heads' in new filing: legal expert

Special counsel Jack Smith not only dismantled former President Donald Trump's arguments for presidential immunity in his latest filing to the Supreme Court, argued legal expert Lisa Rubin on MSNBC's "The ReidOut" Wednesday — he used Trump's own arguments against him.

GOP scholars put Supreme Court on notice not to 'waste its time' on Trump immunity: expert

The Supreme Court is weighing whether to review the D.C. Court of Appeals' wholesale rejection of former President Donald Trump's claim to immunity from prosecution in Jack Smith's federal election conspiracy case — but the pressure mounting against them not to do so is hardly partisan, former acting Solicitor General Neal Katyal told MSNBC's Ari Melber on Wednesday. A number of prominent Republican legal experts are urging them to stay out of it too.

Katyal made this point in response to discussion of former Attorney General Eric Holder, who said of the Trump cases, "We can't have this notion that there's a two-tiered justice system. I laugh at that when I hear Donald Trump and his supporters talk about a two-tiered system of justice. That's not even close to the truth."
