Criminal summons charging Andrew Cuomo with forcible touching was 'issued erroneously': report

A criminal summons charging former New York Gov. Andrew Cuomo with forcible touching was "erroneously issued," according to a report from the Times Union.

According to NBC New York, a spokesman for the state court system confirmed that a misdemeanor complaint against Cuomo had been filed in Albany City Court. The New York Post reported that Cuomo is "expected to be arrested next week."

But the Times Union reported that the "summons was issued without the consent of the alleged victim, Brittany Commisso, or her attorney, Brian D. Premo," citing unnamed sources.

"A sheriff's investigator who had been a lead investigator in the case, in which the governor was accused of groping a female aide at the Executive Mansion last year, had met with a City Court official on Thursday to receive 'guidance' if the department were to file a complaint. It's unclear what happened after that, but a person briefed on the matter and not authorized to comment publicly said that someone in City Court issued the summons," Times Union reported.

The local sheriff's department refused to comment on the matter.

"We have no comment for that at this time," a spokesperson for the Albany County Sheriff's Department told New York Focus. "We are not confirming or denying."
