'I voted for him': Ex-Trump supporter behind lawsuit that axed him from Colorado ballot

One of the plaintiffs who filed a Colorado lawsuit to disqualify Donald Trump from the ballot actually voted for him in the 2020 election he lost.

Krista Kafer, a longtime Republican who was censured by the Arapahoe County Republican Party for her role in the case, appeared Tuesday night on CNN to discuss the ruling by the Colorado Supreme Court that upheld a lower court's finding that Trump engaged in insurrection and was thus disqualified from holding elected office.

"I'm very, very happy about tonight's ruling," Kafer said. "I know there's going to be an appeal. This is really about the rule of law, it's about the Constitution. The constitution is very clear: If a person engages in the insurrection having taken oath of office to the Constitution, tries then to undermine that very document by fomenting an insurrection, as Trump did on Jan. 6, that person is ineligible, and the Constitution is very clear."

"There are five different ways in which one is eligible or ineligible. There's age, there's residency, there's if you've served two terms already and, certainly, if you engaged in insurrection having taken that oath, you cannot, you absolutely cannot, run again, and I think it's clear."

Colorado District Judge Sarah B. Wallace determined that evidence showed Trump had engaged in insurrection, which only a trial court can do, and rejected his First Amendment defense, and the state Supreme Court upheld those findings and removed him from the ballot.

"Due process was done, and I think it's very clear," Kafer said. "I believe that when the U.S. Supreme Court looks at this issue, they look at the evidence, they look at everything, they will conclude the same thing, which is that Donald Trump engaged in insurrection, and he is ineligible to be on that ballot, and you have to consider that this is really about our democracy, it is about Trump involved himself in election interference."

"He tried to erase the votes of millions of voters," Kafer added, admitting that she had been one of his supporters. "Not mine, I voted for him, but millions of my fellow Americans who voted, and he tried to interfere in that, and so we need to ensure that the Constitution is applied, is applied as it is written, and that we do the right thing."
