Ex-prosecutor schools Fox veteran Brit Hume — and perfectly explains how Barr is letting Trump off the hook

Former federal prosecutor Renato Mariotti blasted Fox News analyst Brit Hume for spinning the Mueller report in President Donald Trump's favor.

Special counsel Robert Mueller explicitly did not clear Trump on obstruction of justice, and seemed to refer the matter to Congress for a decision on the evidence, and Rep. Adam Schiff (D-CA) said so.

"The attorney general's actions would make the president above the law such he cannot commit the crime of obstruction of justice," Schiff said. "If the special counsel would have found evidence exonerating the president he would have said so."

Hume slapped the California Democrat, saying Mueller would have said so if he found conclusive evidence of obstruction, and accused Schiff of "spouting nonsense."

Mariotti, who prosecuted white-collar crimes for the U.S. Attorney's Office for the Northern District of Illinois, stepped in to set Hume straight.

"That’s not what Mueller said," Mariotti tweeted. "He indicated that it would be unfair for him to conclude Trump obstructed justice without charging him in court, which Mueller could not do, because the conclusion would give Trump no opportunity for a rebuttal in a court of law."

Hume insisted the investigation had not determined whether the president had committed a crime or not, but Mariotti again explained how Trump was slipping through a narrow gap in Justice Department guidelines prohibiting the indictment of a sitting president.

"He said that he did not 'conclude' that the president committed obstruction of justice because 'fairness concerns counseled against potentially reaching that judgment when no charges can be brought,'" Mariotti said.
