Hunter Biden demands gun charges be dismissed after claiming immunity
October 06, 2023
President Joe Biden’s son asked for gun charges against him to be dismissed Friday claiming he had immunity, according to reports.
The New York Post wrote that lawyers for Hunter Biden argued that a plea agreement signed by prosecutors in June “remains in force, and he will seek to dismiss the Indictment against him pursuant to the immunity provisions of that agreement,” according to a court filing.
The plea deal had been thrown out by a judge, but the lawyers argued that prosecutor David Weiss had already agreed to it.

“If the Special Counsel no longer wishes to pursue that charge, it has the right to do that,” they said.
Hunter Biden has made a not-guilty plea to the charges, which relate to a question asked of gun buyers about drug use. Biden, a known drug abuser, allegedly admitted that he lied to the question in a book he later wrote.
Prosecutors said that the deal had not been approved by the judge or probation officer, and therefore was never valid.
The plea deal would have seen Hunter Biden plead guilty to tax misdemeanors, but enter a diversion program on the felony gun charges. It was rejected after U.S. District Judge Maryellen Noreika questioned the constitutionality of a felony diversion provision for a gun charge.
