While Donald Trump has been indicted for half of the investigation that special counsel Jack Smith has been working on, there is another piece of the probe Smith has been tasked with. There will likely be a major decision about indictments in the Jan. 6 investigation and the attempt to overthrow the 2020 election.
"I think that he will be charged before the election but not tried," said Timothy Heaphy, the former lead investigator for the Jan. 6 committee. "He certainly could decide it is in his interests to ask for a speedy trial. And I think his better chance — I'm not as qualified to make this calculation, but probably his political interests to delay."
He went on to say that Cassidy Hutchinson was a significant witness for their committee because she was so close to Donald Trump in and around those months after the election.
"We keep talking about this, that people that were in the room when it happened who were witness to events and were strong enough, courageous enough to tell the truth about those events moved the needle," said Heaphy. "This was not with all due respect to Rep. [Zoe] Lofgren (D-CA) or me or anybody pulling a rabbit out of the hat. We had really good facts and the facts were really compelling and they came from people like Cassidy Hutchinson who were strong enough to come forward."
He went on to say that it served as a big contrast to Secret Service agents that were either too scared or resistant to testify. After she spoke, he said that others were willing to speak to them.
