Analyst flags 'aggressive' legal filing that's 'threatening' criminal case against Trump

While the media is focusing on Special Counsel Jack Smith's monster legal brief in the prosecutor's criminal case against Donald Trump for alleged 2020 election subversion, there is an overlooked filing that is threatening the existence of the case itself, according to one legal journalist.

Smith's brief has stolen the show, with some media outlets focusing on the details it contains about Trump's purported efforts to overturn his 2020 loss and others emphasizing the timing of the filing in relation to the upcoming presidential election.

But beneath the surface lies an "aggressive" filing by Trump that is putting the case at risk, according to Jordan Rubin, writing for MSNBC....

Judge Cannon's delay just made it 'more possible' Trump faces D.C. trial before election

Judge Aileen Cannon’s decision to "indefinitely delay" former President Donald Trump's criminal classified documents trial might come with a silver lining for special counsel Jack Smith, according to legal experts.

Former Acting U.S. Solicitor General Neil Katyal believes Cannon's postponement will allow Smith's team to put their entire focus on Trump's federal election immunity case, he said in a recent interview on MSNBC.

"Judge Cannon’s decision today has now cleared the docket for Trump,” Katyal said. When host Alex Wagner asked if Katyal thought it possible Smith's election interference case will head to court before Election Day, he said yes. ...

'Preaching to the choir': Judge Chutkan strongly affirms that Jan. 6 'can't happen again'

Judge Chutkan, the jurist overseeing Donald Trump's criminal prosecution in the Washington D.C. case over alleged election subversion, reportedly affirmed that the riot that occurred on Jan. 6, 2021, can't "happen again."

Trump was indicted after Special Counsel Jack Smith accused the former president of knowingly undermining the 2020 election, which was won by President Joe Biden, in a failed attempt to cling to the White House. The case was assigned to Chutkan, who was appointed by President Obama, and she has frequently been a target of Trump's attacks on social media since then.

'Only reporter in Chutkan's courtroom' reveals judge's next steps on Trump trial

Judge Chutkan is reportedly signaling a flexibility that would allow her to easily reschedule Donald Trump's D.C. elections trial, which has fallen off the court's calendar as parties await an appeals court ruling on the former president's claimed absolute immunity.

Chutkan hasn't said much publicly about the Trump trial and the delay that is necessary to determine if the case can continue against the ex-president. But the judge may have given some hints at a minor hearing held earlier on Friday, according to Politico's senior legal affairs reporter, Kyle Cheney.

"I was the only reporter in Chutkan's courtroom earlier today when she made some comments about her upcoming trial calendar," he teased before publication Friday....

'Downright silly': Ex-prosecutor shows why Judge Chutkan will swat down Trump's new motion

'Downright silly': Ex-prosecutor shows why Judge Chutkan will swat down Trump's new motion

Trump trying to hold special counsel Jack Smith and fellow prosecutors in contempt is "unbefitting" and "frivolous," according to former federal prosecutor Glenn Kirschner.

Appearing on "The Legal Breakdown" with Bryan Tyler Cohen, Kirschner roasted the 45th president's legal team for their attempt to get U.S. District Judge Tanya Chutkan in Washington, D.C., to hold Smith and two of his prosecutors in contempt for turning over thousands of pages in discovery and providing an exhibit list — while the case is paused.

They wrote that such work "teems with partisan rhetoric" and "false claims."...

Judge Chutkan rejects convicted Jan. 6 attacker's bid to travel to Cancun: court records

Judge Tanya Chutkan on Thursday rejected a January 6 defendant's motion for permission to travel to Cancun, court records show.

Chutkan, who is also overseeing the federal election subversion case in which former president Donald Trump faces charges, ruled in a brief court docket memo that Antony Vo couldn't go to Cancun. In November, Raw Story reported that Vo was found guilty and decided to visit Mar-a-Lago before facing potential jail time.

In a memo flagged by Politico's senior legal affairs reporter Kyle Cheney, Chutkan has now rejected Vo's bid for travel....
