Publix accused of employee wage theft in federal class-action lawsuit

Publix, the dominant supermarket chain in Florida and the southeastern United States, is accused of not paying several middle managers for work the company forced them to do off the clock, according to a federal lawsuit filed in Tampa. A failure to pay employees for work done would mean the nation’s seventh largest grocer committed a form of wage theft and violated the Fair Labor Standards Act. The lawsuit proposes a collective action to include all non-exempt, hourly paid assistant department managers who worked over 40 hours in a workweek in a Publix store after Oct. 18, 2020. The lawsuit wa......

Apple to pay up to $500 million to iPhone users after judge nixes final appeal

SAN JOSE, Calif. — Owners of some older iPhone models are expected to receive about $65 each after a judge cleared the way for payments in a class-action lawsuit accusing Apple of secretly throttling phone performance. The Cupertino cellphone giant agreed in 2020 to pay up to $500 million to resolve a lawsuit alleging it had perpetrated “one of the largest consumer frauds in history” by surreptitiously slowing the performance of certain iPhone models to address problems with batteries and processors. This week, two iPhone owners who objected to the settlement lost their appeal in the 9th U.S. ......

Sam Bankman-Fried reportedly backed out of Taylor Swift-FTX partnership, not other way around

Taylor Swift wasn’t the one who backed out of a partnership with cryptocurrency exchange FTX, before the company went bankrupt, despite claims to the contrary. In December, reports emerged that the “Anti-Hero” singer, 33, was the reason the deal fell through after six months of negotiations. The deal reportedly would have been valued at around $100 million. Earlier this year, Adam Moskowitz — the class-action lawyer who alleged in a lawsuit that FTX promoters such as Tom Brady and Shaquille O’Neal were among those who misled investors — publicly praised Swift for being “the one person” to do h......

Stabbings, slashings at Rikers Island, other NYC jails have risen since 2016, report says

NEW YORK — Violence at Rikers Island and other city Correction Department jails has eased since 2021 but is still much worse than in 2016 when a federal judge appointed a monitor to oversee the problems, a new report says. Court-appointed violence monitor Steve J. Martin and his staff said that the jails are on pace for 350 stabbings and slashings in 2023. That projection would be lower than the 420 stabbings reported in 2021 and 468 stabbings reported in 2022, Martin’s report noted — but still up from the number of stabbings reported in the early years of his work monitoring violence at Riker......

Venezuelan migrants file class-action lawsuit against DeSantis, Florida

Three migrants who were part of a group that was flown from Texas to Martha’s Vineyard last week by the state of Florida are suing Gov. Ron DeSantis and other state officials. The suit, filed in federal court in Massachusetts, alleges that DeSantis, along with Florida’s Transportation Department Secretary and others, tricked migrants into leaving Texas. The plaintiffs include three anonymous Venezuelan migrants Alianza Americas, a transnational organization that advocates on behalf of immigrants rights. “These immigrants, who are pursuing the proper channels for lawful immigration status in th......

Lawyers in Surfside condo collapse case sought $100 million. Here’s what judge decided

MIAMI — Dozens of attorneys who attained a landmark $1.1 billion wrongful-death settlement in the Surfside condominium calamity learned their cut of the class-action case on Monday. It won’t be as much as they had hoped to receive from a Miami-Dade judge. Miami-Dade Circuit Judge Michael Hanzman awarded attorneys’ fees of $65 million — about two-thirds of the $100 million lawyers had requested before the settlement was approved in June. In addition, Hanzman granted an extra $6.5 million in fees to lawyers who participated in his recent review of victims’ damage claims in the collapse of Champl......
