Trump’s gambit to bury Jack Smith report past midterms about to collapse: ex-prosecutor

Trump’s gambit to bury Jack Smith report past midterms about to collapse: ex-prosecutor

A former federal prosecutor predicts President Donald Trump's latest bid to keep former special counsel Jack Smith's report hidden is about to fall apart.

Harry Litman, a former U.S. attorney, said in a Thursday episode of "Talking Feds" that the 11th Circuit Court of Appeals is likely to reject a request from Trump and co-defendant Walt Nauta to delay a November 2 oral argument over the release of Volume II of Smith's report.

Volume II covers Smith's investigation into Trump's alleged hoarding of classified documents at Mar-a-Lago. U.S. District Judge Aileen Cannon, a Trump appointee, has blocked its release since dismissing the case on the grounds that Smith was unlawfully appointed....

Real 'tragedy' of Supreme Court's new Trump ruling 'staring us in the face': legal expert

Real 'tragedy' of Supreme Court's new Trump ruling 'staring us in the face': legal expert

Former U.S. Attorney Harry Litman warned that the Supreme Court's latest Trump ruling carries a "real tragedy" that outlasts the ballroom case.

In a Thursday piece for his Talking Feds Substack, Litman wrote about the Supreme Court's 5-4 decision in the White House ballroom. The Monday decision cleared President Donald Trump to "proceed full steam ahead to construct his monstrous ballroom," Litman wrote.

The decision lifted a lower-court block on the White House project, but the "per curiam, 5-4 order on the shadow docket expressly offered no opinion on the merits," Litman blasted. He argued that the wording of the ruling has little to do with legal arguments about who could sue and who a construction pause would harm....

'Hidden costs' of Trump DOJ's corruption come home to roost as cases stall: expert

'Hidden costs' of Trump DOJ's corruption come home to roost as cases stall: expert

The Justice Department's "nakedly political" prosecutions have made it harder to convict criminals, which will hurt the public, a former prosecutor warned.

In a Tuesday Substack article, former U.S. attorney Harry Litman argued that the reprisal prosecutions dominating the headlines, including cases against figures like James Comey and Letitia James, are only one face of what he called "the other side of the DOJ's corruption." The more damaging fallout lands where few are looking, he warned.

Litman pointed to a run of losses in Washington's federal courthouse under D.C. U.S. Attorney Jeanine Pirro, whose office has "spent the presumption [of regularity] down to nothing." Jurors now take their seats "already jaundiced" toward a department they no longer trust, so even strong cases are buckling, he warned....

'Cataclysmic': Trump's 'October ambush' at the Supreme Court flagged by legal expert

'Cataclysmic': Trump's 'October ambush' at the Supreme Court flagged by legal expert

A legal expert warned that a motion filed by the Trump administration in the Supreme Court could become an "October ambush."

Former U.S. Attorney Harry Litman wrote in a Friday piece that he sees the "elements of a potential perfect storm" that could lead to President Donald Trump blocking mail-in voting before the November midterms.

Litman's concerns stem from a Trump Executive Order signed in late March that would create federal voter rolls by directing the Department of Homeland Security to compile state-by-state lists of citizens deemed eligible to vote. It would also direct the U.S. Postal Service to refuse to send a mail-in ballot to any voter who doesn't appear on the list, Litman wrote....

'Getting away with it': Todd Blanche's evasive maneuvers in hearing alarm legal experts

'Getting away with it': Todd Blanche's evasive maneuvers in hearing alarm legal experts

A pair of veteran prosecutors sounded the alarm as Acting Attorney General Todd Blanche seems to be "getting away with it."

During a Wednesday episode of Civil Discourse, former federal prosecutors Joyce Vance and Harry Litman weighed in on the first day of Blanche's confirmation hearing before the Senate Judiciary Committee, but were disappointed by the questions from senators so far.

"Todd Blanche is getting away with it," Vance said. "He has not had any significant trouble. Some of the questions have been good... but nothing seems to be touching Blanche. His demeanor continues to be abrasive."...

'Took my breath away': Expert flags 'precarious situation' Supreme Court just created

A law expert warned on Wednesday that the Supreme Court's decisions this week — and its reluctance to conclusively resolve central constitutional issues — should concern Americans.

Former federal prosecutor Harry Litman discussed the high court's major decisions and "blockbuster term" during a Substack video and conversation with Melissa Murray, NYU Law professor and co-host of Strict Scrutiny. They focused on the potential ramifications connected to the birthright citizenship case and questions that remain following the ruling.

"They’ve done the right thing and stood up for the court’s right to citizenship, but they could have done it a year ago," Murray said. "So, you know, I guess points for reading. No points for taking a year to read."...
