Kash Patel lawsuit set to backfire with records 'unlikely to be pretty': legal expert

Kash Patel lawsuit set to backfire with records 'unlikely to be pretty': legal expert

FBI Director Kash Patel's defamation lawsuit against The Atlantic will drag embarrassing records into open court, a legal expert predicted.

Former federal prosecutor Joyce Vance wrote in her Substack "Civil Discourse" on Wednesday that Patel's attack is likely to backfire. Patel is suing The Atlantic and reporter Sarah Fitzpatrick for a story that cast him as an incompetent drunk endangering national security.

The Atlantic moved to dismiss the lawsuit in July, and Patel filed his response earlier this week. Patel argued that the case is too early in litigation to toss, but Vance argued that Patel is opening the door to a discovery process he won't be able to control. Vance, a former U.S. Attorney, said the coming fight over records from the Department of Justice and testimony would not go Patel's way....

'Getting away with it': Todd Blanche's evasive maneuvers in hearing alarm legal experts

A pair of veteran prosecutors sounded the alarm as Acting Attorney General Todd Blanche seems to be "getting away with it."

During a Wednesday episode of Civil Discourse, former federal prosecutors Joyce Vance and Harry Litman weighed in on the first day of Blanche's confirmation hearing before the Senate Judiciary Committee, but were disappointed by the questions from senators so far.

"Todd Blanche is getting away with it," Vance said. "He has not had any significant trouble. Some of the questions have been good... but nothing seems to be touching Blanche. His demeanor continues to be abrasive."...

'What happened?' Todd Blanche's former colleague 'disgusted' by his transformation

'What happened?' Todd Blanche's former colleague 'disgusted' by his transformation

A former colleague of Acting Attorney General Todd Blanche said that she's "very surprised" and "disgusted" by his "major transformation" under Trump.

During an interview on Civil Discourse with Joyce Vance, former federal prosecutor Mimi Rocah described how "very upsetting" it is to see who Blanche has become in the Trump administration. She spoke with Joyce Vance, a former federal prosecutor, about her memories of Blanche ahead of his confirmation hearing before the Senate Judiciary Committee on July 15 to become attorney general.

In 2001, Blanche was a paralegal at the Southern District of New York who "had a very good career," Rocah remembered. She described him as a family man with kids, a "team player," and a "hard worker" who "seemed to be the person doing it all" when Rocah knew him at SDNY....

Trump DOJ's defiance backfires as judges move to revive contempt case: legal expert

The Trump administration's defiance of federal judges is starting to backfire as a contempt case is revived, according to a legal expert.

Former U.S. Attorney Joyce Vance wrote in a Tuesday piece for her Civil Discourse Substack about a long-running fight over the March 2025 deportation of Venezuelan men to El Salvador's CECOT prison.

Chief U.S. District Judge James Boasberg ordered the planes carrying the Venezuelan men to turn back and return the men, but the Trump administration landed the planes and handed the men over anyway, Vance recounted....

Trump's newest revenge probe has 'one faulty premise' that could undo case: expert

Trump's newest revenge probe has 'one faulty premise' that could undo case: expert

A criminal probe launched by the Department of Justice into the Southern Poverty Law Center could be undone by one detail, a former federal prosecutor has claimed.

Joyce Vance, who served as the United States attorney for the Northern District of Alabama from 2009 to 2017, believes the DOJ will have a hard time convincing people its investigation is just. The DoJ indicted the Southern Poverty Law Center on criminal fraud charges, alleging the civil rights organization misled donors about how contributions would be used.

FBI Director Kash Patel and acting Attorney General Todd Blanche accused the SPLC of using donations to pay informants infiltrating extremist groups without disclosure. However, legal experts and former law enforcement officials have harshly criticized the prosecution....

Ex-attorney raises red flag over Trump's 'revenge prosecution list' target

Ex-attorney raises red flag over Trump's 'revenge prosecution list' target

President Donald Trump has made his next target for prosecution clear, a former attorney has claimed.

Joyce Vance, who served as the United States attorney for the Northern District of Alabama from 2009 to 2017, suggested former CIA Director John Brennan could be in the firing line of Trump's legal wrath. Writing in her Substack, Vance considered the reasons why Brennan would be made a prosecution target for Trump, with the former CIA Director incurring the president's wrath.

Former CIA Director John Brennan faces potential criminal prosecution under the Trump administration. Legal experts warn that no federal court is likely to convict Brennan of crimes. ...
