Trump's Colorado insurrection ban appeal puts SCOTUS under 'a lot of pressure': Expert
Former President Donald Trump amped up pressure on the U.S. Supreme Court Wednesday when he finally appealed the Colorado decision bumping him from the state ballot, CNN legal correspondent Paula Reid said on Wednesday.
The Colorado Supreme Court's insurrectionist ban ruling remains on hold as the nation grapples with historic precedent and appeals from the state's Republican party, and now Trump himself, Reid noted.
"We need clarity for all 50 states in this country about this issue," said Reid.
"Because it's been popping up elsewhere," said anchor Jake Tapper.
"New Hampshire, Minnesota, Michigan," added Reid. "And while most states...opted to keep him on the ballot, they left the door open to re-litigate this. So the Supreme Court is under a lot of pressure to weigh in here."
Reid critiqued Trump's filing as less articulate than the one filed by the Republican Party, which asked the court to decide if Section 3 — the 14th Amendment clause banning insurrectionists from federal office — applies to presidents.
"That's an important question, because even within Colorado, the Supreme Court was split there because the word does not appear," Reid said. "We need clarity on that."
The Republicans also demanded a ruling on who should enforce the ban — states or U.S. Congress.
In comparison, Trump's appeal asks the court to consider if the Colorado Supreme Court erred in striking him from the 2024 primary ballot, Reid said.
But Trump's ruling amps up pressure because now the Supreme Court has two demands for their consideration.
"We could get an answer at any time about whether the Supreme Court wants to take up this issue," Reid said. "They now have two separate appeals."
