House Speaker Mike Johnson (R-LA) tried his best on Wednesday to back up President Donald Trump's crusade against members of Congress who posted a video reminding servicemembers they have a duty to refuse illegal orders. But he broke with the president on one key aspect of the case: whether they should be prosecuted for it.

The video, put out months ago by a number of lawmakers with a military background including Sen. Mark Kelly (D-AZ), prompted Trump and his allies to threaten them with prosecution and even suggest their actions are punishable by death.

Trump admin's prosecution of Don Lemon could crumble over this obscure clause

President Donald Trump's administration is trying to prosecute former CNN reporter Don Lemon, for his presence at a protest in Cities Church in Minnesota that targeted a pastor who has worked with Immigration and Customs Enforcement. One of the main charges stems from the Freedom of Access to Clinic Entrances (FACE) Act, a statute traditionally used to stop anti-abortion protesters from interfering with patients, but which also has a provision granting similar protections to houses of worship.

Some experts and pundits have speculated the case could be thrown out due to the First Amendment's protection of freedom of the press — but in fact, Anna Bower, Eric Columbus, and Troy Edwards argued for Lawfare on Wednesday, there's a different provision of the Constitution that makes a much stronger case for throwing out the FACE Act charges: the Commerce Clause.

Trump attacks GOP governor for canceling White House meeting that excluded Democrats

President Donald Trump lashed out at Oklahoma Gov. J. Kevin Stitt (R), chair of the National Governors Association, after he said that the bipartisan organization would not participate in a White House event that excluded some Democrats.

"The invitations were sent to ALL Governors, other than two, who I feel are not worthy of being there."

'Do better!' Pam Bondi gets earful from furious Dem for 'covering up' right-wing terrorism

Attorney General Pam Bondi faced harsh grilling on Capitol Hill Wednesday from Rep. Sydney Kamlager-Dove (D-CA), who demanded to know, among other things, why her Justice Department pulled down a report on the dangers of violent right-wing extremists — and the congresswoman grew visibly frustrated as Bondi sidestepped the question.

"I want to go back to what [President Donald Trump] said about [Minnesota Gov.] Tim Walz," said Kamlager-Dove, referring to the president's promotion of conspiracy theories that Walz had a hand in the assassination of former Minnesota House Speaker Melissa Hortman and her husband.
