Expert doubts 'bomb' dropped onto Trump's verdict will derail sentencing

Donald Trump's attorneys will almost certainly try to delay sentencing due to a comment about the case left on the court's Facebook page, but a legal expert cast doubt on their chances of halting the process.

New York Justice Juan Merchan brought the comment, in which a social media user claimed their cousin was a juror and thanked them for their hard work, to the attention of Trump's lawyers and prosecutors but did not ask either party to take any action, and MSNBC's Lisa Rubin told "Morning Joe" the post would not likely pause sentencing.

Fox News this week hyped up a purportedly "eye-popping" revelation about Supreme Court Justice Ketanji Brown Jackson disclosing that she received concert tickets from pop star Beyoncé whose value totaled nearly $4,000.

However, Fox's report almost completely overlooked the far more substantive gifts that were reported by right-wing Supreme Court Justice Clarence Thomas, who has disclosed accepting gifts from assorted wealthy donors whose value tops $4 million, or roughly 1,000 times more than the purportedly "eye-popping" Beyoncé tickets.

Trump lawyers facing 'an uphill climb' to get appeals court to bow to his wishes

The odds of attorneys for Donald Trump to get an appeals court to rule in their client's favor if they appeal his conviction on 34 felony counts are slim at best.

That is according to appellate lawyer and a former N.Y. prosecutor Robert Stavis in a column for the New York Times, where he claimed he sees no egregious errors made by Manhattan District Attorney Alvin Bragg's office or how judge Juan Merchan conducted the trial.

Decreasing Trump's odds of a favorable ruling is the fact that the appeals court's history documents the fact that the justices only toss out convictions in approximately 4 to 6 percent of cases.

According to Stavis, "To warrant reversal of a jury’s verdict on account of an error, the appellate court must find that an error of some kind led directly to the conviction. A technical error that does not rise to that level is called a 'harmless error' and will not cause a reversal of a conviction."

The attorney noted that there appears to be only one avenue for the Trump legal team to pursue, writing that "if the Appellate Division has some concerns with the verdict, it will probably focus on the legal theory that provided the framework for the trial. This will offer the strongest chance for a successful appeal."

"When the appellate court digs into the complicated nature of these charges after Mr. Trump inevitably appeals, it must decide if the charges were unduly vague and thus may have violated constitutional due process," he explained before adding that another Trump legal loss at the appellate level may never get a Supreme Court hearing.

"For the case to reach the U.S. Supreme Court, it must reach and get through a decision of the Court of Appeals. But this seems like an unlikely case for the Supreme Court to hear; the appellate issue concerns a New York criminal statute, rather than the type of grave constitutional or federal statutory issue ordinarily reviewed by the Supreme Court," he wrote.

Trump defied 'any sense of reality' in Vegas rally speech: MSNBC analyst

Reacting to Donald Trump's speech on Sunday at a rally in scorching Las Vegas, MSNBC contributor Donny Deutsch hammered the former president for calling the Jan. 6 rioters "hostages," before accusing him of creating a fake "reality" for his supporters.

Speaking with Deutsch, "Way Too Early" host Jonathan Lemire suggested Democrats will use footage of Trump's fans storming the Capitol and attacking Capitol police as the election nears.

"Let's start with Donald Trump," Lemire prompted his guest. "This is not a new refrain, him praising the January 6th insurrectionists; now, calling them heroes and contrasting them with the Capitol police, just a new low."

"Also using the word hostages," Deutsch replied. "You know, with what's going on in Israel. We have hostages we know all too well and sadly. To call them hostages is ridiculous. J6, all of the sudden now it's a thing because he's branded it, J6 and that the police said, 'come on in, come on in.'"

You're staring at this and going, 'What planet am I on?"'
