'The problem is policies': Legal expert tears into MAGA spin on 'activist judges'
Georgetown Law professor Steve Vladeck on Monday published a comprehensive takedown of President Donald Trump's claims that he's being targeted by purported "activist judges."
Writing on his personal blog, Vladeck took a look at all the judges who have blocked assorted Trump administration policies — and found that the judges in question are far from wild-eyed left-wing radicals.
"Although judges appointed during the first Trump administration have been especially reticent to rule against the federal government to date, there are plenty of examples of adverse rulings by judges appointed by other Republican presidents," he wrote. "The data strongly suggests that the cause of this unprecedented flurry of judicial activity is neither the judges nor the courts; it’s the policies they’re reviewing."

Vladeck says that the rulings from the Washington D.C. federal district court have been particularly instructive, as "judges appointed by Republican presidents have been almost as active in blocking Trump initiatives as their colleagues appointed by Democratic presidents."
All of this suggests, Vladeck concludes, that Trump's cries about being treated unfairly by biased judges are simply propaganda with little to no basis in reality.
"At some point, if this many different judges in this many different courts appointed by this many different presidents are blocking this many policies promulgated by the same president, we ought to be able to agree that the problem is the policies—not the judges," he writes.
