Jack Smith now has 'devastating' evidence against Trump that juries 'eat up': expert

According to MSNBC legal analyst Danny Cevallos, the unearthed recording of Donald Trump and RNC chair Ronna McDaniel plotting with Michigan election officials to block the certification of the 2020 presidential election votes will likely be front and center when special counsel Jack Smith presents his case in Judge Tanya Chutkan's courtroom.

After being prompted about the phone call by "Morning Joe" fill-in host Jonathan Lemire, Cevallos began by noting that "there was a lot of talk this last week about, well, could this expose him to liability in a Michigan court? Maybe. But far more interesting to me, having defended federal criminal cases, I can tell you federal court is not a fun place to be for a criminal defense attorney because the government is very good at what they do."

'Even for him, a new low': Morning Joe panel rips apart Trump's Christmas freakout

On the first "Morning Joe" episode the day after Christmas, the pared-down MSNBC panel immediately pounced on Donald Trump for his ugly tirade on Truth Social where his Christmas message included wishing people would "rot in hell."

Fill-in in host Jonathan Lemire kicked off the discussion by reading from the former president's post where Trump wrote, "Merry Christmas to all, including Crooked Joe Biden’s ONLY HOPE, Deranged Jack Smith, the out of control Lunatic who just hired outside attorneys, fresh from the SWAMP (unprecedented!), to help him with his poorly executed WITCH HUNT against 'TRUMP' and 'MAGA' Included also are World Leaders, both good and bad, but none of which are as evil and 'sick' as the THUGS we have inside our Country who, with their Open Borders, INFLATION, Afghanistan Surrender, Green New Scam, High Taxes, No Energy Independence, Woke Military, Russia/Ukraine, Israel/Iran, All Electric Car Lunacy, and so much more, are looking to destroy our once great USA. MAY THEY ROT IN HELL. AGAIN, MERRY CHRISTMAS!"

Lemire then turned to Rev. Al Sharpton and asked, "The anger from Donald Trump, the bad faith attacks about his political opponents, what does that say to you just about where he is right now mentally and emotionally as this year draws to a close and we barrel into an election year?"

"It's two things," Sharpton began. "I think it shows that these indictments and the civil case, despite his pretense otherwise, has gotten to him, because he's reacting and responding in a way of no one projecting self-confidence or like this is nothing."

"I also think it shows an inner kind of anger and displacement that he has, because who spends the holiday with this kind of venom, particularly when he is a guy that claims to be this self-confident, self-made guy with this kind of darkness, unless you are just that kind of dark person," he added.

"We've certainly gotten used to Trump's unorthodox holiday messages, 'the haters,' but this one hit a new low, even for him," Lemire chipped in.

Prosecutor shows why Trump's D.C. trial will go down 'well before' 2024 election

Donald Trump's recent Supreme Court victory, which saw the high court refusing to expedite review of the former president's arguments that he's immune from prosecution in the D.C. election subversion case, won't stop him from being tried "well before" the 2024 election, a Florida prosecutor said Monday.

State Attorney for Palm Beach County Dave Aronberg on Christmas day appeared on MSNBC's Richard Lui Reports, where he was asked about the rejection Special Counsel Jack Smith saw at the Supreme Court when he asked to leapfrog another appeals court. Aronberg began by suggesting Trump was attempting to put himself above the law, and make himself a "king," by seeking presidential immunity in the criminal matter.

Trump warned by former DOJ official the D.C. Court of Appeals is 'onto his game'

During an appearance on CNN on Christmas day, former Deputy Assistant Attorney General Harry Litman claimed Donald Trump shouldn't get too comfortable thinking the D.C. Court of Appeals will take its time ruling on whether he is covered by presidential immunity for alleged crimes he committed related to the Jan 6 insurrection.

Speaking with host Kate Bolduan, the former prosecutor stated, "I think the court of appeals is not going to be very welcoming of this general immunity argument. What he's trying to say basically is he was acting as president not as a candidate, not trying to do anything wrong just looking out for the election integrity."

"I don't think that's a position that's going to fly," he predicted. "On the other hand, right now it does delay the start of the trial and in that sense he gets an important advantage on one level."

Pressed on the former president's legal strategy, he elaborated, "Trump will try, of course, to string it out by going to the full court of appeals or the Supreme Court but if the court of appeals gives us stay with a short fuse, which is just what the Colorado court did a few days ago, that will hand him in and that's going to be the real lookout."

"Will they keep him from delaying?" he added. "They seem to be onto his game and worried about letting things trail along too long."
