Conservative radio host: Individual mandate is greatest threat 'since segregation'
A conservative radio host who is president of the legal advocacy group Landmark Legal Foundation believes that President Barack Obama's health care reform law created the biggest threat from government "since segregation" by requiring individuals to purchase health care insurance.
"Obama and a super majority of Democrats in the House in the Senate -- which don't exist anymore because the people threw them out last time -- decided that they were going to grab as much power as they could," Mark Levin told Fox News host Neil Cavuto on Thursday. "The problem is they didn't confer with the Constitution or they took a look at it and didn't give a damn what it said. You can not impose on individuals in this country, American citizens, a requirement that they participate in commerce if they choose not to."
"This has never been done in American history before so when you hear all these loser lawyers come on your show and other place and say the court has never stricken down anything like this, Congress has never passed anything like this."
Cavuto pointed out that "a lot of CEOs" tell him that just striking down the individual mandate wouldn't be enough: "You've got to kill the beast here, that you've got to strike down the entire law."
"They're quite right," Levin agreed. "The individual mandate is the greatest threat against the relationship between the individual in this country and the government we've faced since segregation. And I want to be very clear about that because we cannot have government telling us what to do and pushing us around this way so it is crucial that that provision of the statute to be stricken."
"And I predict if the rest of the statute or most of it survives -- much of which, we still don't know what's in there because, you know, they have to issue regulations -- they're going to be aggressive legal challenges. We're not going to wait around for Congress or the next election -- aggressive legal challenges attacking it, and I'm going to be one of them with Landmark Legal Foundation who intends to do it."
The United States Supreme Court is expected to hand down a ruling on the Affordable Care Act on Thursday morning.
