When Trump speaks 'he is a clear and present danger': legal analyst

Discussing an upcoming ruling on a gag order issued by Judge Tanya Chutkan, MSNBC legal analyst Danny Cevallos told host Alex Witt that judges on the D.C. Court of Appeals have to keep in mind that, when Donald Trump rants about court workers, their lives are endangered.

"Here's an indisputable fact," he told the host. "When Trump speaks, they [his followers] do stupid things – that is an undisputed fact."

"So the next step is, in this analysis, do we curtail Donald Trump's speech because of this behavior of other people that are not Donald Trump?" he suggested. "And the answer may be as simple as 'yes' because when he speaks it presents a clear and present danger. It needs that exacting standard."

After some technical difficulties with his audio, he explained Trump is not like "some criminal defendant no one's ever heard of. If he doesn't like the judge or doesn't like the clerk, he can shout all he wants, he can yell out the window, tweet to his 30 followers, and it just won't have the effects. Maybe never in American history has one human being had this effect when they speak."

"That is why this is a unique situation," he added. "It may simply be the case that Donald Trump is entitled to less speech because of how dangerous the speech can be, unlike anybody else in American history."

'A witless show of arrogance': Trump trashed for appearance at SC/Clemson football game

Donald Trump's appearance at the South Carolina/Clemson football game on Saturday was greeted with a loud chorus of boos and, on Sunday, a brutal review by McClatchy columnist Isaac Bailey who dropped the hammer on the former president and the "cowards" who invited him to take the field.

In a column published on Sunday by South Carolina's "The State," Bailey wrote that the game, which he described as "a quasi-religious holiday in the Palmetto State," now carries the "stench" of a Trump appearance.

As part of his brutal brutal appraisal of the former president, whom he called "a 91-time indicted and credibly-accused sexual abuser," the columnist also blasted South Carolina Gov. Henry McMaster (R) who accompanied the former president, writing the governor "should be ashamed. But you’d have to possess a shred of integrity for shame to be even a possibility, so I get why he isn’t."

"The University of South Carolina should be ashamed. But it is apparently run by cowards comfortable bending the knee to an obviously-compromised governor, and an even more compromised presidential candidate who inspired a violent attack at the heart of our democracy just a couple years ago," he wrote before adding, "Whoever signed off on that pathetic Trump parade should be fired, though I suspect given how far we’ve fallen from any sense of decency, they may have already received a raise."

In that vein, he pointed out that Trump showed up at the football game in South Carolina but refuses to share the debate stage with former Gov. Nikki Haley (R-SC) who is also running for the 2024 GOP presidential nomination.

That, Bailey claimed, is evidence the former president is a "coward."

"It’s that they knew everyone with the power to stop their witless show of machismo and arrogance would roll over and let them do whatever the heck they wanted to do," he wrote before concluding, "Haley’s team won the football game, and she won an important political victory against a man who brags about how tough he is but whose decision to fly into Columbia was political weakness. McMaster and others pretended the man they treated like an emperor had new clothes. But those of us with eyes, and a functioning brain, know the truth, that he was exposed as the naked coward’s bully he’s long been."

'Fat cat' GOP lawmakers leveled by former senior aide over 'the monster that became Trump'

During an appearance on MSNBC on Sunday morning a former senior aide who worked for congressional Republicans lashed out at the direction the party is still taking and its continuing allegiance with the embattled Donald Trump.

Speaking with MSNBC fill-in host Charles Coleman Jr., Rina Shah called out GOP lawmakers who "still bear responsibility for the monster that became Trump."

Explaining how Trump has taken over the party," she told the host, "He spoke to these Americans who were so frustrated with members of Congress that just didn't serve them. They had this anger, that visceral anger is still very much there. They feel like these members of Congress are fat cats serving themselves and there's all this evidence that shows that is true."

"You can't get out of that lane unless you do a hard pivot," she suggested. "So, yes, there's a lot of people within today's GOP that still bear responsibility for the monster that became Trump. But I think, at this point, it's the only way to save the party — and that's why I remain and I believe we need two healthy parties at least in the system in order for our democracy to thrive and that's why we still remain right-of-center."

'Zero chance': Trump Georgia lawyer's ploy to get confidential DOJ evidence shot down

A bid by Donald Trump's lead attorney in the Georgia racketeering case to force Department of Justice investigators pursuing the Trump election federal case in a D.C. courtroom to hand over their evidence was shot down by former U.S. Attorney Barbara McQuade.

In short, she told MSNBC host Katie Phang: " Zero chance."

During an appearance on MSNBC early Sunday morning, McQuade was asked about Trump attorney Steve Sadow asking for evidence the DOJ has compiled on Trump's actions surrounding the Jan 6 insurrection that will be used in Judge Tonya Chutkan's courtroom next year.

"His criminal defense lawyer has actually asked the Fulton County judge to have the federal prosecutors who are in the Judge Chutkan D.C. election interference case to turn over its list of evidence which is otherwise being held confidentially up in D.C. so that Sadow can determine if there is relevant evidence from that D.C. case to use for the defense down in Georgia," host Phang prompted. "How successful is Sadow going to be to obtain the evidence list that is otherwise not up for public consumption?"

"Yeah, I think there is zero chance of getting that," McQuade quickly replied. "These are separate sovereigns who are engaging in separate prosecutions. Although [Fulton County DA] Fani Willis has a duty to turn over any evidence she's going to use in the trial and any evidence that is exonerating for the defense and the right to a fair trial, she doesn't have access to what's going on in federal court and neither does the defense. "

"They have absolutely no duty to turn this over," she added. "I think they play these strategies so often, even when they know there is zero chance of prevailing, to have another issue to complain about it in the press and show supporters how unfair the process is. That's absolutely not true; it's one more thing to complain about."

Trump lawyers accused of 'misleading' the court to block gag order

With a D.C. Appeals Court set to make a ruling on a gag order imposed upon Donald Trump this coming week, a former U.S. attorney claimed lawyers for the embattled former president have been "misleading" the court as they battle with the Department of Justice.

Speaking with MSNBC host Katie Phang, former prosecutor Barbara McQuade claimed the court needs to take seriously the threats being aimed at court officials in multiple jurisdictions after Trump ranted about them in speeches and on his Truth Social platform.

According to McQuade, arguments made by Trump's lawyers last week had nothing to do with the matter at hand.

"Let's speak quickly about this Appeals Court appearance for Donald Trump," host Phang prompted. "He seems to spend a lot of time in trial court, he is in appellate courts a lot. There was a filing done in the New York AG civil fraud case appeal by the state, by New York state. It detailed thousands of horrible, violent, antisemitic messages that were being received by the law clerk as well as Judge [Arthur] Engoron."

"From an evidentiary perspective, does the Appeals Court take that into perspective what is going to be hearing oral arguments tomorrow?" she asked.

'I think so, Katie," the former prosecutor replied. "That is because it shows that it's not imaginative or speculative harm. These are real threats coming in every day and disrupting the business of the court, putting its employees in harm's way."

"One of the things that the [Trump] lawyers have done, that is very misleading here, is to look at cases outside of the context of court, of opinion criminal cases. You know, prior restraints are frowned upon of course. Anything that limits core political speech is antithetical to the 1st Amendment."

"That's not the world that we are in," she elaborated. "We are in the world of a trial. And so inside a trial to protect the parties, to protect court staff and to protect the fair administration of justice, those rules are different. And so I hope that the court sees the light and understand the very threat on the one hand versus the restriction on the other."
