Update: Wendy Davis filibuster succeeds amid chaos as Republicans fail to legally pass anti-abortion bill
Republicans in the Texas Senate voted to sustain a point-of-order against state Sen. Wendy Davis (D-Fort Worth) on Tuesday night because she received help with back-brace.
The point-of-order was the second warning she received during her hours long filibuster against legislation that would shutter all but five abortion clinics in the state. If she receives a third point-of-order, Republicans will be able to end the filibuster and pass the bill.
Lt. Gov. David Dewhurst said legislators were required to stand upright the entire length of their filibuster. They cannot receive any form of assistance, including help from another person or leaning on their desk for support.
Davis received some help from a fellow lawmaker when attempting to adjust a back-brace.
State Sen. Judith Zaffirini (D-Laredo) half-jokingly noted the filibuster rules only used male pronouns such as "his" and therefore if literally interpreted they should not apply to Davis.
Earlier in the day, Davis received her first warning for not staying on topic in her filibuster.
