Former federal prosecutor and MSNBC legal analyst Mimi Rocah listed the federal crimes the FBI will likely be investigating when they interview Prof. Christine Blasey Ford in San Francisco on Friday.
"Mimi, what with insights do you have as a former prosecutor about the FBI's role here?" Andrea Mitchell asked. "And we know that we have confirmed that it is only the president, the White House who can ask them to get back into the confirmation process, but this is a different matter."
"Yes, this is entirely separate," Rocah noted. "And it absolutely should be investigated."
Rocah noted the threats could be considered witness tampering as "she is a potential witness in a federal proceeding, which a congressional confirmation hearing would be."
"Those are federal crimes prosecuted all over to the country, and the FBI is very well equipped and they do a forensic analysis if they are emails or text messages or phone calls and even social media," Rocah explained. "And I have seen prosecutions just based on the social media postings."
"So this is something that the FBI is very good at and they should take very seriously here," she concluded.
