Alan Dershowitz: Michael Flynn is innocent because ‘lying to the FBI is not a crime’

Law professor Alan Dershowitz on Monday argued that former National Security Adviser Michael Flynn should never have pleaded guilty in special counsel Robert Mueller’s Russia investigation because “lying to the FBI is not a crime.”

During an interview on Fox News, Dershowitz asserted that Flynn’s lie about speaking to the Russian ambassador regarding removing sanctions was not “material” to the Russia investigation.

“I hope the judge understands when he has the case tomorrow that Flynn did not commit a crime by lying,” Dershowitz told Fox News host Bill Hemmer. “Because the lie has to be material to the investigation. And if the FBI already knew the answer to the question and only asked him the question in order to give him an opportunity to lie, his answer — even if false — was not material to the investigation.”

“Lying to the FBI is not a crime!” the law professor added.

“Why not just tell the truth?” Hemmer wondered.

In a court filing last week, the special counsel insisted that “nothing about the way the interview was arranged or conducted caused the defendant to make false statements to the FBI.”

“The interview was voluntary, and lacked any indicia of coercion,” Mueller said in the document.

The Des Moines Register released their latest polling of Iowa on Saturday.

"Democrat Theresa Greenfield leads Republican U.S. Sen. Joni Ernst by 3 percentage points in a Senate race that appears to be among the most competitive in the country," the newspaper reported. "With just over six weeks to Election Day, the new Des Moines Register/Mediacom Iowa Poll shows Greenfield leading 45% to 42% among likely voters. Another 3% say they would vote for someone else, 2% say they would not vote in the race and 7% are unsure."

President Donald Trump insisted he would withdraw from public life should he lose the 2020 presidential election.

Trump, who has been a public figure since he started appearing in tabloid stories in the 1980s, made the promise during a campaign rally North Carolina on Saturday.

"If I lose to him, I don't know what I'm going to do," Trump said, in comments that will stoke fears he may try to hold onto power regardless of the will of the voters.

"I will never speak to you again, you'll never see me," he vowed.
