The defense attorney for Michael Flynn's former business partner complained in federal court that his client never would have been indicted -- were he not partners with Donald Trump's former National Security Advisor.

Bijan Kain was charged with conspiracy and acting as an unregistered agent of a foreign government.

Kian attorney Mark MacDougall argued that the case would have been resolved "civilly or administratively" were it not for the relationship with Flynn, Politico reported.

Federal prosecutor James Gillis told Judge Anthony Trenga that such a claim simply is not true.

“Even if [Kian] did not have any business partner in this case, it would have been brought,” Gillis told the judge.
