A panel of legal experts on Fox News came to the conclusion on Monday that Kim Davis’ attorney, Mat Staver, was “ridiculously stupid” for asserting that the Supreme Court did not have constitutional authority to strike down same-sex marriage bans.
On Monday’s edition of Happening Now, trial attorney Chip Merlin pointed out that anyone who violates a judge’s order should “expect to be thrown in jail.”
“She can still practice her faith,” Fox News host Gregg Jarrett noted. “Just not on the job in a way that interferes with the legal rights of the citizens she serves. And in fact, the U.S. Supreme Court said so nine years ago.”
“She’s a hypocrite,” criminal defense attorney Sharon Liko agreed. “She’s applying for the job of a martyr. She wants to practice her faith by not issuing marriage licenses. Yet, she will not agree to let the deputy county clerks issue marriage licenses even if it’s okay with their faith.”
“When she took the job she swore to uphold the law,” Jarrett explained. “We rely on government officials to do that. They can’t just pick and choose what laws they like, which ones they don’t. If they were allowed to do that, wouldn’t that lead to chaos, anarchy and so forth?”
Jarrett also called out Davis’s attorney, who said it was “questionable” if the Supreme Court had the “constitutional authority” to rule on same-sex marriage.
“Whether the Supreme Court has constitutional authority?” the Fox News host said. “Article III Section 2 of the Constitution gives the Supreme Court constitutional authority to decide constitutional issues!”
Jarrett added that Staver’s statement appeared to be “stunningly obtuse.”
“That’s a very polite way of putting it,” Liko replied. “I would say it’s just a ridiculously stupid statement. The Supreme Court does just that, and they determine constitutionality issues, they resolve these kinds of disputes.”
“This woman has a choice, she can either follow the law — she can do her job — or she can get out.”

Sen. Lindsey Graham (R-SC) this week defended the federal government's top infectious disease expert after President Donald Trump and the White House put out statements defaming him.
At a press event on Tuesday, Graham was asked about the attempts to smear Dr. Anthony Fauci.
The Republican senator praised Fauci as "one of the smartest people I know."
"Has he been right all the time? No," Graham said. "We don't have a Dr. Fauci problem. We need to be focusing on doing things to get us where we need to go. So, I have all the respect in the world for Dr. Fauci."
‘Excessive force’: Video catches five NJ cops wrestling Black man to ground over open beer
Five New Jersey police officers are being accused of using excessive force after they were seen wrestling a Black man to the ground for allegedly having a open beer at a beach.
Video of the incident, which was said to have occurred at Point Pleasant, was shared on social media.
In the video, at least five officers can be seen forcing a man to the ground.
A witness later explained that the officers could have issued the man a ticket instead of arresting him.
"We watched 5 cops surround one man," the witness wrote in an Instagram post. "They stopped him for publicly drinking. One had a ticket book out & I couldn't understand why they wouldn't write him a ticket and send him on his way."

Police in Brooklyn were seen tackling and then firing a Taser at a Black man who shouted in an officer's face.
Video shared by journalist Scooter Caster shows a white officer yelling at a Black man.
When the Black man shouts back, another officer runs toward the man and tackles him.
After the man returns to his feet, the first officer fires a Taser, knocking the man back to the ground.
"Oh, he's going to lose his job," one protester notes.
Within seconds, officers restrain the man as he objects.
"You Tased me!" the man screams. "I didn't do nothing!"
