
Former Prosecutor Shan Wu railed against the idea of the Department of Justice launching an investigation into President Joe Biden's use of the auto pen on several different documents toward the end of his presidency.
“The idea of launching an investigation into President Biden's use of the autopen, where does this go?” Anchor John Berman asked.
“Under a normal DOJ situation, it would go absolutely nowhere. I mean, there's just no predicate for opening this type of examination,” Wu said.
“DOJ itself has said, and the auto pen is fine to use. Trump himself has used an autopen, so it's very hard to understand how this has any basis going forward. But nonetheless, we'll probably see a bit of publicity around it.”
He added, “Ultimately, as a crime, a criminal investigation, I just don't see that it has any legs to stand on.”
The documents in question are all pardons issued by Biden, including to family members, members of the Jan 6. Committee and death row inmates.
An autopen is a machine that has the ability to replicate any signature.

Biden’s statement went on to say, “This is nothing more than a distraction by Donald Trump and Congressional Republicans who are working to push disastrous legislation that would cut essential programs like Medicaid and raise costs on American families, all to pay for tax breaks for the ultra-wealthy and big corporations.”
The investigation comes as Trump and other Republicans continue to question Biden’s mental health. Biden was diagnosed with prostate cancer earlier this year.
Wu’s reaction came while he broke down several different topics on the network, including Trump's travel ban and moves against Harvard.
