A ex-U.S. Army soldier who shot and killed a handcuffed civilian in Iraq has been charged with civil disorder and assaulting cops during the Jan. 6 Capitol riot, CBS 2 reported.

Edward Richmond Jr., 40, was previously convicted of war crimes during his service in Iraq.

The killing of the civilian took place near Taal Al Jai, Iraq, in February 2004. Richmond shot Muhamad Husain Kadir, a cow herder, in the back of the head from about six feet away after the man stumbled. Richmond claimed he didn't know Kadir was handcuffed and thought he was going to attack another soldier.

Prosecutors say video shows Richmond repeatedly assaulting police with a baton during the violence on Jan. 6, 2021.
