Trump's actions exposed in fraud trial could tank his criminal elections case: expert

Legal expert and former Justice Department prosecutor Andrew Weissmann pointed to a document in Donald Trump's fraud trial that could sink him in the 2020 federal election case.

Weissmann was watching the fraud case in New York on Wednesday when he saw that Donald Trump Jr. was asked about the actions around the Donald J. Trump Revocable Trust. While Don. Jr. said that he didn't do much and didn't know much, one thing he did reveal is that in Jan. 15, 2021, Trump Sr. took over the trust immediately after leaving the White House. Up until that point, CFO Allen Weisselberg and Don Jr. were in charge of the trust.

'Surprising': Legal expert shames Judge Cannon for being too 'snarky' in Trump filing

The former general counsel to the FBI, Andrew Weissmann, was shocked and appalled by Judge Aileen Cannon's behavior in a court filing on Wednesday.

Reading the filing, he posted on social media that it was "snarky" and "too far" for a federal judge. He noted no good deed goes unpunished, with the prosecutors "ben[ding] over backward to give defense counsel access to docs. It could have argued they should not have access to it at all. Why? So defense counsel could make arguments about them to the court. Upshot: Cannon dings the government for taking that route."

It was the first time Trump Jr. had stepped foot in the courtroom, though his brother Eric has been present for much of the proceedings and has been largely polite to others present, even shaking hands with Attorney General Letitia James who brought the lawsuit against his family's business, said MSNBC's senior legal correspondent, Laura Jarrett.

Former President Donald Trump's son Eric has already been deposed ahead of testifying in the civil fraud case against the Trumps in New York State. It's 'chilling' Trump thinks he's not responsible for supporter violence: legal expert

Former senior prosecutor at the Justice Department and former FBI general counsel Andrew Weissmann pointed to Donald Trump's appeal of the gag order in the 2020 election case, calling it "chilling."

The gag order is under appeal, and Judge Tanya Chutkan had paused it while deciding whether or not it would be fully paused pending appeal. In a filing last week, special counsel Jack Smith explained that pausing the gag order is a dangerous move as he already went on a rant against his former chief of staff, Mark Meadows. It comes at a time when Meadows was reportedly given immunity in the same case.
