
Newsmax judicial analyst Andrew Napolitano agreed with a federal judge who ruled that National Guard troops federalized by President Donald Trump should be returned to the control of California's governor.
"There is no longer any emergency," Napolitano explained. "There are some protests, they're basically peaceful, they're not even newsworthy anymore. And the normal federal assets, federal buildings obviously have their own protective service, called the Federal Protective Service, are sufficient to protect federal assets."
"And so the troops should go back to Gavin Newsom's control," he continued. "These are still California people, California troops that have been federalized, meaning they're under the control of the Secretary Hegseth and ultimately the president, taken away from Governor Newsom."
Napolitano said he was "not surprised" by the ruling.
"You know, the judge made an interesting comment, which is right up my libertarian alley," he added. "He goes, this is getting close to a federal police force, which the Constitution does not permit."
