Donald Trump's immunity claim has been denied, court records show.
The New York Second Circuit Court of Appeals denied Trump's request Monday to reconsider his immunity claim in the civil lawsuit brought by former journalist E. Jean Carroll, court records show.
Said Politico reporter Kyle Cheney, first to spot the filing, "SCOTUS is the next stop."
A federal appeals court first denied the claim in December, ruling that Trump had waited too long to raise that specific defense, reports show.
Trump argued he couldn't be sued for comments about Carroll's sexual assault allegations made in 2019 because he was president and it was his duty to defend his reputation, NBC reported.
But the three-judge panel ruled unanimously that Trump should have raised the defense three years ago.
