During his Monday afternoon show, Fox News host Shep Smith slammed Donald Trump's attorney Rudy Giuliani for repeatedly making the "straw man" argument that collusion with Russia is not a crime.

The host ran a supercut of Giuliani during his twin appearances on Fox & Friends and CNN in which he repeatedly tried to assert that "collusion is not a crime" — a doubling-down on his claim that Trump did not collude, but if he did, it wouldn't be against the law anyway.

"I'm sitting here looking at the federal code trying to find collusion as a crime," Giuliani told the hosts of Fox & Friends Monday morning in the clip Smith played on the network that afternoon.

"Giuliani is making a straw man argument," the host said, "and it's deceptive."

"While the U.S. Criminal code does not criminalize collusion," Smith continued, "it is against the law to influence or undermine our election or any other action."
