
During an appearance on MSNBC on Saturday morning, former U.S. Attorney Barbara McQuade claimed the amended second lawsuit filed by writer E. Jean Carroll against Donald Trump for defamation appears to be a slam-dunk win for the woman who already was awarded $5 million from the former president by a Manhattan jury.
Moving past Trump's other legal travails while speaking with host Ali Velshi, McQuade perked up when the topic turned to Carroll's second lawsuit.
"This is the case that goes back to the comments Donald Trump made while he was president," she explained to the host. "And then they amended the complaint to add the comments he made at that CNN town hall after the verdict in what was sometimes referred to as Carroll 2 based on the 2019 statements."
"So there had been an argument that the statements that Donald Trump made while president might be protected by some sort of immunity because he was serving as president and the Justice Department had weighed in on that," she continued. "But now by amending the complaint to add these things that he made, statements he made after he left office, I think it takes any of those arguments off the table, a jury will be able to hear about this defamation."
"Gosh, if there's ever a stronger case, I don't know what it is for proving defamation," she exclaimed. "The day after a jury found that he made defamatory statements against her -- and he did in fact sexually assault her -- he says it again. And so I think not only is liability very strong here, but I think the probability of very strong punitive damages is so much higher, just because it's on notice now; a jury has found that his statements were false, and so I think she is in very good legal standing."
"I give her credit for bringing these cases," she concluded.
