Legal expert explains what could delay Trump charges

Donald Trump's lawyers met with the Justice Department Monday and reportedly asked that prosecutors don't indict the former president.

Special Counsel Jack Smith has completed all the interviews he'd planned, which legal experts explained signals he is ready to proceed with the indictment. Former U.S. Attorney Barbara McQuade said on MSNBC Monday that Attorney General Merrick Garland could have already given him the "green light" to pursue charges.

But experts are reluctant to say too much.

"I think we have some, you know, hints and signals," said MSNBC legal analyst Laura Jarrett.

"But the problem with this is that the grand jury process is secret. If we report a certain day, and it moves, it looks like a mess. We're trying to be careful with what we know and don't know, and what we do expect is that it's going to happen this week. The fact that his attorneys are in there now is, again, one of the signs pointing to this being in the final stages."

The investigation into Trump involves classified documents he's accused of keeping at his Mar-a-Lago home.

Jarrett explained that all of the witnesses have already been questioned in the documents case. However, what could delay the charges is if someone new comes into the picture.

Host Katy Tur asked if a witness could come into the grand jury on the same day they voted to pass down the indictment.

Jarrett said that could happen, but explained folks should be cautious about it. "What if a witness goes in and tells them something they haven't heard before or what if a witness somehow remembers, 'Oh, there was a document left somewhere.' So, much about it is still unknown for us and why it's important that we just let go of what we know."

Even in that instance, the grand jury could vote to indict that day after hearing the witness, she said.
