Jack Smith will seek to expedite Trump's Supreme Court immunity appeal: Fox News

Special counsel Jack Smith reportedly wants to expedite Donald Trump's appeals after a panel of judges ruled that he does not have immunity from prosecution.

In a 3-0 ruling on Tuesday, a federal appeals court said Trump could be prosecuted for election subversion crimes related to Jan. 6, 2021.

Trump was expected to appeal to the Supreme Court by Feb. 12, when a stay on his prosecution is set to expire.

"We are waiting for some reaction from Jack Smith's team to see if the special counsel is weighing in," Fox News correspondent David Spunt explained following the ruling. "This is clearly a win for him, a unanimous decision."

"The trial was scheduled to begin in Washington, D.C., on March 4th," he continued. Now that the U.S. Court of Appeals has ruled against the former president, he has the right to take this to the Supreme Court."

But Smith's team was ready for Trump to try to delay the case, Spunt said.

"But I'm also told by sources in Jack Smith's office, I was told a couple of weeks ago that it's likely that the special counsel will try to get this expedited to the Supreme Court because he wants to get this back on track as soon as possible," he remarked.
