
Donald Trump may have already violated the terms of his release when he was seen on video accepting and handling a firearm, according to Jack Smith's recent filing.
The prosecutor on Friday said the former president was seeking special treatment in his opposition filing to the government's request for a gag order. In the filing, Smith says Trump's opposition brief is "premised on inapplicable caselaw and false claims."
However, Smith raised an additional concern in a footnote of the brief.

"The defendant recently was caught potentially violating his conditions of release, and tried to walk that back in similar fashion," Smith wrote in a footnote. "In particular, on September 25, the defendant's campaign spokesman posted a video of the defendant in the Palmetto State Armory, a Federal Firearms Licensee in Summerville, South Carolina. The video posted by the spokesman showed the defendant holding a Glock pistol with the defendant's likeness etched into it."
Smith went on to say that Trump can be seen in the video saying "I've got to buy one" before posing for pictures with the owners of the gun store.
"The spokesman subsequently deleted the post and retracted his statement, saying that the defendant 'did not purchase or take possession of the firearm,'" the filing says.
