'Will not turn out well': Trump may be facing 'considerable financial fines' from Judge Chutkan

According to former U.S. Attorney Carol Lam, Donald Trump could be on the hook for "serious" financial sanctions levied by United States District Court for the District of Columbia Judge Tanya Chutkan if he continues to ignore her admonitions about what he can say about his ongoing trial.

Reacting to a report that special counsel Jack Smith is asking for a gag order to keep the former president from harassing witnesses and investigators, Lam suggested that, even if a limited gag order is put in place, that won't necessarily stop the former president from spouting off.

As she told MSNBC host Ali Velshi, Chutkan might be able to get Trump's attention by hitting him in the wallet.

"This is a power struggle between Judge Chutkan and Donald Trump and Judge Chutkan is going to win this battle," she stated. "This is why she will do it in a measured way and [special counsel] Jack Smith is proceeding in a measured way, and they're saying, 'Here is the evidence of what he's done in the past and there is a concern about what he's going to do in the future.' and, Judge Chutkan, what are the tools she has in the toolbox."

"She does not want to arrest him and put him in custody until the election or until the trial -- that's going to be problematic," she continued. "But she can impose pretty considerable financial fines. She can say, 'Your first financial fine, your first transgression is going to be X amount of dollars. The next time you're doing it it's going to be twice that amount' and she can keep going up."

"So once she imposes an order and once he violates that order now we are not really talking about First Amendment so much anymore, we are talking about the court's orders," she elaborated. "With respect to the line where the First Amendment is drawn, it's always a tricky line."

"Remember who Judge Chutkan's ultimate audience is: it's the Court of Appeals and perhaps the Supreme Court," she explained. "Who are they? They are judges. They understand the importance of keeping control over a trial and the judicial system and I think ultimately they're going to play this correctly and it's not going to go well for Donald Trump."

Special Counsel Jack Smith on Friday asked U.S. District Judge Tanya Chutkan to narrowly limit the speech of defendant Donald Trump in the federal government's case prosecuting the ex-president's alleged attempts to overturn the 2020 election. One legal expert praising the DOJ's move says it also puts it "one step closer to raising the concern that Trump's intimidation of witnesses violates his conditions of release," while another says at this point DOJ had "no choice."

Judge Chutkan has a better option than a Trump gag order: Ex-prosecutor

Trump lashed out at Smith Friday night, both on social media and during a speech at a prayer summit, after Chutkan unsealed the request by Smith to limit what the former president says about the case. Trump also appeared to admit he lost the 2020 election at the prayer summit.

Trump is now 'one step closer' to jail before trial: legal expert

Former President Donald Trump's odds of having his bail revoked and having to wait in jail pending trial just went up, argued New York University law professor and former Defense Department special counsel Ryan Goodman on Friday evening.

This comes after U.S. District Judge Tanya Chutkan unsealed a filing from special counsel Jack Smith, outlining how the former president has continued to attack and threaten witnesses as he awaits trial in the 2020 election interference case. As of now, Smith is not pursuing remand but simply a limited gag order.

New Jack Smith filing accuses Trump's lawyer of rule violation: Mueller prosecutor

The big news from Jack Smith today was the unsealing of a request from the special counsel to put a narrow gag order on former president Donald Trump in his criminal elections case in D.C. But buried inside that request was something else, according to former top Mueller prosecutor Andrew Weissmann's account.

The gag order request is the most recent development in the criminal action against Trump, coming just after Trump asked Judge Chutkan to recuse herself from the case due to the potential appearance of a bias. Last month, legal experts suggested that Trump's lawyer John Lauro in the Washington D.C.-based election conspiracy case may have already violated a criminal rule in that jurisdiction.

Judge Chutkan unseals Jack Smith filing alleging new Trump witness intimidation

U.S. District Judge Tanya Chutkan has released a redacted filing by prosecutors working for special counsel Jack Smith, alleging that former President Donald Trump engaged in new incidents of witness intimidation.

The filing, which was made last week by prosecutors, was known for several days to involve "extrajudicial statements" by the former president. It alleges that Trump's "inflammatory" statements have led to "threats and harassment" against people in the case, and that he "will continue to make similar personal attacks, knowing that they may prompt similar harassment."
