In a court filing submitted in late December as part of a lawsuit contesting the status of Trump administration officials serving unconfirmed in "temporary" positions, lawyers with the U.S. Justice Department argued the case should be tossed out because the issue would soon "be moot" given that President Donald Trump lost the 2020 elections and would soon leave the Oval Office.

Raffensperger combats Fox News host on Trump tape: ‘I don’t understand how truth would jeopardize the country’

George Conway delivers bad news to Trump on prison time potentially awaiting him for Georgia election tampering

Reacting to a Washington Post bombshell report that contained audio of Donald Trump begging and then demanding Georgia's secretary of state recalculate the presidential election vote totals in his state and find him close to 12,000 votes, attorney George Conway let the president know that he just committed a crime on tape and could potentially be looking at some jail time.

According to the Post report, Trump told Republican Brad Raffensperger, "So look. All I want to do is this. I just want to find 11,780 votes, which is one more than we have. Because we won the state. There's no way I lost Georgia. There's no way. We won by hundreds of thousands of votes."

That, Conway suggested, amounted to election tampering. Conway is the husband of former Trump advisor Kellyanne Conway and a founding member of the Lincoln Project.

With that in mind, he helpfully tweeted for the president -- and whoever is acting as his lawyer these days -- the relevant penalties for attempting or proposing fraud.

According to 52 U.S.C § 20511(2)(B): "A person, including an election official, who in any election for Federal office- knowingly and willfully deprives, defrauds, or attempts to deprive or defraud the residents of a State of a fair and impartially conducted election process, by- (A) the procurement or submission of voter registration applications that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held; or
(B) the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held, shall be fined in accordance with title 18 (which fines shall be paid into the general fund of the Treasury, miscellaneous receipts (pursuant to section 3302 of title 31), notwithstanding any other law), or imprisoned not more than 5 years, or both."

Republican lectured by CNN's Tapper on why the GOP's proposed election commission will flop

On Sunday morning, Ohio Gov. Mike DeWine (R) made an impassioned case for a voting commission proposed by 12 Republican senators in lieu of certifying the election of former Vice President Joe Biden on January 6th, saying it would allay voters worries of voter fraud.

DeWine defended the proposal after host Jake Tapper revealed that every GOP lawmaker who signed on to the plan refused to appear on "State of the Union" and explain themselves.

Near the end of the sometimes contentious interview, DeWine explained once again how the commission could work -- only to have host Tapper disabuse him of the notion it would have any impact on the president or Trump voters who believe the election was stolen.

"I'm saying we have to restore confidence in the people in this process," DeWine argued. "You can go through and talk about why we have this, the reality is it's not healthy in our system for that many people to think the system is not working."


"I want to turn to COVID-19 but let me make two points," Tapper proposed. "The why is important because the why is that President Trump and his minions -- and I'm not including you or [Republican Sen. Rob] Portman -- but President Trump and his minions have been lying for weeks about this election and because of that the people have been lied to and they have concerns. The solution is they should stop lying."

"Not that simple," DeWine protested.

"It is that simple," the CNN host shot back. "Let me finish my second point. The second point is, whatever blue-ribbon commission is formed and whatever they conclude, President Trump will attack them the same way he has attacked every single Republican who has stood up for election integrity, whether it is the governor of Arizona or the governor of Georgia or the commissioner of Philadelphia who is a republican, the Maricopa County Board of Canvassers."
