Missing Secret Service Text Messages now under criminal probe

NBC News Pete Williams and Julia Ainsley are reporting that the inspector general's investigation into the Department of Homeland Security over the missing text messages from Jan. 5 and 6, 2021, has now become a criminal probe. The results of what unfolded could also be referred to federal prosecutors for indictment.

"The DHS Inspector General informed the Secret Service on Wednesday evening that the investigation is now criminal and that it should halt all internal investigations on the missing text messages," a letter relayed to reporters says.

U.S. District Judge Carl J. Nichols told a jury at Steve Bannon's contempt trial Wednesday afternoon that claims of executive privilege by former President Donald Trump are "irrelevant." Bannon has said that he refused the committee's subpoena because Trump claimed to have "executive privilege."

Nichols instructed the jury that executive privilege and an offer to later cooperate were not legitimate defenses for contempt of Congress.

AG Todd Rokita who threatened to go after abortion doctor hit with formal complaint

Republican Indiana Attorney General Todd Rokita has been hit with a formal misconduct complaint over his threats to prosecute Dr. Caitlin Bernard, who performed an abortion for a 10-year-old rape victim from Ohio. During a recent Fox News interview, Rokita attacked Bernard's credentials as a doctor and said he and his office were looking into potentially having her license to practice medicine pulled.

"We have this abortion activist acting as a doctor with a history of failing to report," Rokita said. "So we're gathering the information. We're gathering the evidence as we speak and we're going to fight this to the end, including looking at her licensure, if she failed to report."

Garrett Ziegler, a former aide to Trade Advisor Peter Navarro is expected to speak to the January 6th Committee on Tuesday morning. Ziegler announced his interview in a message to his followers on Telegram at the stroke of midnight on Monday, writing, “Yours truly going before the scam committee on Tuesday morning. Such a joke, but don’t worry — I’ll do nothing but tell the truth: Trump did nothing wrong & the election was stolen! ”The Telegram post has since been removed.

Ziegler played a crucial role in facilitating an infamous late-night meeting in the Oval Office on Dec. 18, 2020 by using his guest access pass to usher lawyer Sidney Powell, retired Lt. General Michael Flynn and former Overstock.com CEO Patrick Byrne into the White House. In the meeting, which has been a topic of great interest to the committee, they proposed a plan to have the president invoke the Insurrection Act while ordering the National Guard to seize voting machines and re-run the election in states narrowly lost to Joe Biden. Ziegler described the events of that evening in the video below.
