Enrique Tarrio's two-decade jail sentence should make Trump sweat: legal expert

Enrique Tarrio, the former leader of the Proud Boys militant group, was just given the longest sentence yet for the Jan. 6 riots, and MSNBC's Chuck Rosenberg explained how that might impact Donald Trump's prosecutions.

The former president has been charged by special counsel Jack Smith's office for his own role in the insurrection, and Rosenberg told "Morning Joe" that Tarrio's conviction and sentence was instructive because, like Trump, he wasn't present at the U.S. Capitol during the attack but his leadership role was factored into his trial and penalty.

'Trump whisperer' walks through how he will 'test the limits' of his trials

Former President Donald Trump will continue to ramp up his attacks on judges and prosecutors as he "tests the limits" of what he can get away with in his criminal trials, said New York Times reporter Maggie Haberman, also known as the "Trump whisperer."

This comes as former Proud Boys leader Enrique Tarrio is sentenced to 22 years in prison for seditious conspiracy for the January 6 attack, based partly on domestic terrorism considerations — which, Haberman argues, is not going to influence Trump's calculus in his own defense.

Former prosecutor makes the case for putting Trump on an ankle monitor

A legal expert on Tuesday said that as a presidential candidate, Donald Trump’s public comments in connection with his sprawling legal woes present unique challenges for prosecutors and could lead to a request to have his movements monitored.

Former federal prosecutor Eli Honig during an appearance on CNN’s “Anderson Cooper 360” said should Trump violate terms of his bail agreement, it would be unthinkable for prosecutors to ask that the former president be jailed.

A federal appeals court on Tuesday handed what appears to be a partial victory for Rep. Scott Perry in the Pennsylvania Republican's effort to block special counsel Jack Smith from investigating data on his phone that was seized by the FBI, Politico reports.

Federal investigators in August 2022 seized Perry’s phone amid an investigation over allegations former President Donald Trump and his allies tried to overturn the 2020 election. They have been unable to access it because Perry filed a legal challenge, citing his privilege as a federal lawmaker.

Donald Trump's co-defendants will start clamoring to cooperate soon enough, according to an attorney who recently defended Oath Keepers members in a Jan. 6 case.

The former president has been indicted along with 18 allies in Georgia on racketeering and other charges related to his scheme to overturn the 2020 election results, but attorney Gene Rossi told CNN that reports showing that special counsel Jack Smith is probing post-election fundraising may pose a real threat to conservative attorney Sidney Powell, in particular.

How Jack Smith’s expansion of Trump election probe could increase Sidney Powell’s 'legal peril'

In contrast to Fulton County, Georgia District Attorney Fani Willis' broad, far-reaching case, special counsel Jack Smith's prosecution of former President Donald Trump's efforts to overturn the 2020 election results is often described by legal experts as lean and mean.

But according to CNN reporters Zachary Cohen and Paula Reid, Smith is, in some ways, "widening" his investigation. And this increases the possibility that some of Trump's allies "could still face legal peril" because of their efforts to help Trump stay in office in 2020 despite losing the election to now-President Joe Biden.
